As a Divorce lawyer, I often encounter stories that remind me why I chose this profession. One recent case stands out, involving a young woman named Rekha and her daughter, Priya. Rekha’s story is a stark reminder of the importance of understanding one’s legal rights and the strength it takes to confront fear and manipulation.
The Initial Consultation
Rekha came into my office looking defeated, with dark circles under her eyes and a heaviness in her demeanor. She had been enduring her husband’s gaslighting for years. Her husband Sahil was a classic case of Narcissism and gaslighting. In 20 years of marriage Sahil had convinced Rekha that she was powerless and she cannot walk away from their marriage and even if she tried she may not receive any help from police or from the court. His constant threats and manipulation had eroded her self-confidence, making her believe that seeking legal recourse was futile.
The Reality of Gaslighting
Gaslighting is a form of psychological abuse where the abuser manipulates the victim into doubting their reality, making them feel helpless and dependent. Rekha was a classic case of this insidious tactic. Sahil had her convinced that no court would believe her, that she was unworthy, and that she would end up with nothing but more heartache.
Educating Rekha About Her Rights
During our first meeting, I patiently explained to Rekha that her husband’s threats were baseless. I walked her through her legal rights, emphasizing that the court would consider the welfare of her daughter, her contributions to the marriage, and the equitable distribution of marital assets and her right to maintenance for herself and for her daughter. Rekha was initially skeptical, the fear in her eyes and kept checking time in fear. However, I assured her that the law was on her side and that she deserved a fair and just outcome.
Building Her Confidence
Over the next few weeks, my role extended beyond just legal counsel. I became her confidant and supporter. I encouraged her to document every instance of gaslighting and any other form of abuse. I introduced her to support groups and therapists who could help rebuild her self-esteem. The process was painstakingly slow, but gradually, Rekha began to see the truth of her situation and the strength she possessed. Her worst challenge was being able to live in the same house after filing for protection orders or money reliefs.
The Court Battle
After filing for divorce she was scared that Sahil may become very violent and harm her if he finds out she had approached court. However this was strategically planned with police help who went to serve the court summons upon Sahil. Although initially he was shocked and angry, he became very apologetic to Rekha and started conveying to her that they should resolve all differences between themselves and not involve court or police. Rekha was told to expect this and also warned not to mellow down at that stage or withdraw any cases. To Rekhas surprise, since matter was in court, behavior of Sahil improved at home although the communication was totally broken down. When the day of the court hearing arrived, Rekha walked in with her head held high even though she was nervous but resolute.
Presenting the case
Our team of lawyers, presented various applications and evidence Rekha had gathered, showcasing the extent of Sahil’s manipulation and abuse. Initially we were only concerned for her safety and insisted protection orders were awarded to Rekha. The court recognized Rekha’s contributions as a mother and wife, and her dependency on Sahil for monthly maintenance and in due course Sahil was ordered to provide monthly maintenance for Rekha and her daughter which was deducted from Sahils salary account and transferred to Rekhas bank account.
Shifting into her own house
Rekha managed to get residence orders where the court also directed Sahil to make provisions for rental accommodation for Rekha and their minor daughter and slowly Rekha had the courage to shift to her own separate house which was close by to her matrimonial house and since the situation was so troublesome and financially draining for Sahil, he proposed to sell his house and share the sale proceeds to meet the court orders. Eventually settlement terms were drawn to secure everyone with a fair share including Sahils security as he shifted beyond the city limits to a bigger house while Rekha chose to continue residing in the same area for her daughtes schooling.
A New Beginning
The victory in court was not just a legal win but a significant emotional triumph for Rekha. She was no longer the frightened, manipulated woman who first walked into my office. She was a courageous mother ready to start a new chapter in her life.
Rekha’s story is a powerful reminder of the importance of legal education and emotional support for victims of gaslighting and abuse. As a divorce lawyer, my job is not only to navigate the legal complexities but also to empower my clients to stand up for their rights and reclaim their lives.
